    1. Acceptance of Terms

    By creating an account on NZ Drive Test ("the Website", "we", "us", "our"), you ("the User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, and any additional guidelines referenced herein. If you do not agree, you must not use the Website.

    2. Eligibility

    You must be at least 16 years of age (or the minimum driving‑licence eligibility age in your jurisdiction) to register. By creating an account you confirm that the information you provide is accurate and complete.

    3. Account Registration & Security

    • You are responsible for maintaining the confidentiality of your login credentials.
    • You must not share your account with others or allow unauthorised access.
    • We reserve the right to suspend or terminate accounts that violate these terms.
    • You agree to provide a valid email address and accept that email verification may be required.

    4. Exam Services & Mock Tests

    • The mock exams provided are for practice and educational purposes only. They do not guarantee success in the official New Zealand driving theory test.
    • Question content may be updated, modified, or removed at any time without notice.
    • Exam results and scores are indicative only and may not reflect official testing standards.
    • Free exams are provided at our discretion and may be limited, modified, or withdrawn at any time.
    • You must not systematically extract, copy, or redistribute questions, answers, or any exam content.

    5. Purchases & Payments

    • All purchases of exam credits are processed securely through Stripe.
    • Prices are displayed in New Zealand Dollars (NZD) unless stated otherwise.
    • By making a purchase you confirm that you are the authorised cardholder or have explicit permission to use the payment method.
    • You agree not to use stolen, fraudulent, or unauthorised payment methods. Any such activity will result in immediate account termination and may be reported to law enforcement.
    • All sales are final unless otherwise required by applicable consumer protection law. Refund requests are assessed on a case‑by‑case basis.
    • We reserve the right to change pricing at any time; existing purchased credits will remain unaffected.

    6. Gift Cards & Referral Programme

    • Gift cards are non‑refundable and subject to expiry dates displayed at the time of issue.
    • Each gift card code may only be redeemed once.
    • Referral credits are granted when a genuine new user signs up using your unique referral link and meets eligibility criteria.
    • You must not create fake, duplicate, or fraudulent accounts to exploit the referral or gift card system. Abuse will result in forfeiture of credits and potential account termination.
    • We reserve the right to modify, suspend, or discontinue the referral and gift card programmes at any time.

    7. Free Exam Credits

    Free exam credits are intended for personal, individual use only. You must not abuse, exploit, or manipulate the free credit system by creating multiple accounts, using automated tools, or any other means. We reserve the right to revoke free credits and suspend accounts engaged in such behaviour.

    8. Leaderboard & Display of User Information

    • By opting into the leaderboard, you consent to your display name (as set in your profile) being shown publicly alongside your exam scores and rankings.
    • You may opt out of the leaderboard at any time through your profile settings.
    • We reserve the right to remove any user from the leaderboard whose name, behaviour, or activity is deemed inappropriate.

    9. Email Notifications

    By registering you agree to receive transactional and service‑related emails including, but not limited to, account verification, purchase confirmations, and important service updates. You may also receive promotional communications from which you can unsubscribe at any time.

    10. Cookies & Tracking

    • The Website uses cookies and similar technologies for authentication, session management, analytics, and improving user experience.
    • By using the Website you consent to the use of cookies as described in our Cookie Policy.
    • You may manage cookie preferences through your browser settings, but disabling essential cookies may impair Website functionality.

    11. Prohibited Conduct

    You agree not to:

    • Attempt to hack, exploit, or gain unauthorised access to the Website, its servers, databases, or other users' accounts.
    • Launch denial‑of‑service (DoS/DDoS) attacks or engage in any activity that disrupts or degrades the Website's performance.
    • Use automated bots, scrapers, or similar tools to interact with the Website without our written consent.
    • Reverse‑engineer, decompile, or disassemble any part of the Website's software or infrastructure.
    • Circumvent, disable, or tamper with security‑related features, including answer validation and access controls.
    • Impersonate another person or entity or misrepresent your affiliation with any person or entity.
    • Upload or transmit viruses, malware, or any other malicious code.
    • Use the Website for any unlawful purpose or in violation of any applicable laws or regulations.

    12. Intellectual Property

    All content on the Website — including questions, images, graphics, logos, text, software, and design — is the property of NZ Drive Test or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

    13. Privacy & Data Protection

    • We collect and process personal data (name, email, exam history, payment information) in accordance with the New Zealand Privacy Act 2020.
    • Your data is stored securely and is not sold to third parties.
    • We may share limited data with payment processors (Stripe) and email service providers to deliver our services.
    • You have the right to access, correct, or request deletion of your personal data by contacting us.

    14. Disclaimer of Warranties

    The Website and its services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Website will be uninterrupted, error‑free, or free from harmful components. We make no guarantee regarding the accuracy, completeness, or reliability of any content or exam results.

    15. Limitation of Liability

    To the maximum extent permitted by law, NZ Drive Test and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website, including but not limited to loss of data, revenue, or examination outcomes.

    16. Indemnification

    You agree to indemnify and hold harmless NZ Drive Test, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or misuse of the Website.

    17. Termination

    We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Website ceases immediately. Any remaining exam credits may be forfeited.

    18. Modifications to Terms

    We may update these Terms at any time. Continued use of the Website after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes via email or Website notice.

    19. Governing Law

    These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
